CAISO Tariff Section 20 Notice of Requests for Information

Summary
The California Energy Commission (CEC) has issued and served on the California ISO (CAISO) a subpoena for the production of certain documents and information related to its evaluation of Resource Adequacy. The due date for any objections to the production of responsive information is 4:00 p.m. (PDT) Friday, August 15, 2008.

The CEC has issued and served on the CAISO a subpoena requesting the production of certain documents and information related to its evaluation of Resource Adequacy. A copy of the subpoena may be viewed at http://www.caiso.com/201d/201d955a107f0.pdf. To the extent the requested documents and information are confidential and/or commercially sensitive under CAISO Tariff Section 20 and/or the CAISO Information Availability Policy Section 4.3, the CAISO will seek confidential treatment of such documents and information and will produce such materials subject to the protective terms set forth in the CEC’s letter confirming confidentiality, dated July 31, 2008. Any Market Participant that objects to the CAISO producing the requested documents and information must submit by 4:00 p.m. (PDT) on Friday, August 15, 2008, a court order or other appropriate order that prohibits disclosure in response to the subpoena. Unless the CAISO receives such an order by that due date, the CAISO will thereafter respond to the subpoena.
