On March 29, 2022, the Federal Energy Regulatory Commission (FERC) approved a stipulation and consent agreement between its Office of Enforcement and Constellation NewEnergy, Inc. (CNE) – Constellation NewEnergy, Inc., 178 FERC ¶ 61,231 (2022). CNE agreed to disgorge $2.3 million to the California ISO, which FERC has ordered the ISO to allocate “pro rata to network load.” The ISO will distribute the disgorgement amount pro rata by each scheduling coordinator’s share of total metered demand in June 2017 and August 2017.

The disbursement will be included in Neutrality charge code CC 8989 on the May 31, 2022 T+9B initial settlement statement publishing on June 13, 2022. Billing for this statement will be reflected on the weekly invoice issuing on June 15, 2022.
