The California ISO has posted the Exempting Inter-Scheduling Coordinator Trades from Commodity Futures Trading Commission Jurisdiction draft final proposal and has scheduled a stakeholder call on May 18, 2012 to present the proposal and solicit stakeholder comments. The California ISO has posted the Exempting Inter-SC Trades from Commodity Futures Trading Commission (CFTC) Jurisdiction draft final proposal to its website at http://www.caiso.com/Documents/Inter-SC_TradesOversightExemptionDraftFinalProposal.pdf and has scheduled a stakeholder call on May 18 to present the proposal and solicit stakeholder comments.
On February 7, 2012, ISOs and RTOs filed a joint application with the CFTC for an exemptive order. If granted, the proposed order would exempt nearly all ISO products and services from CFTC oversight but would not cover inter-SC trades. Inter-SC trades could be considered "swaps" under the Commodity Exchange Act. If these trades are not exempted the ISO must comply with the full range of requirements imposed by the Commodity Exchange Act, a significant burden for the ISO and market participants. The draft final proposal discusses additional conditions necessary to expand the requested exemption to include inter-SC trades.
