Request to Disclose Confidential Attachment to FERC Filing - Petition to Distribute Penalty Proceeds and Interconnection Deposits
Public Citizen, Inc. has requested access to confidential attachments included in the California ISO’s Nov. 8, 2018 filing in Federal Energy Regulatory Commission (FERC) Docket No. ER19-308. Absent an objection to disclosure filed in that docket, the ISO intends to provide the requested materials at the expiration of the five-day deadline specified in 18 CFR 388.112(b)(2)(iv).
On Nov. 8, 2018, the California ISO filed a petition with FERC in Docket No. ER19-308 requesting approval to distribute Rules of Conduct penalties collected in calendar year 2017 and certain forfeited deposits for interconnection studies. The ISO’s filing with FERC included two confidential attachments reflecting the proposed distributions of the Rules of Conduct and forfeited deposit funds, respectively. Those attachments include three columns of information relating to the scheduling coordinators that would be receiving a distribution: (a) the dollar amount of total funds that scheduling coordinator paid in grid management charge (GMC) for 2017; (2) their 2017 GMC as a percent of all GMC paid by scheduling coordinators with a proposed distribution; and (3)
the dollar amount of their proposed allocation.
On Nov. 19, 2018, Public Citizen, Inc. requested access per 18 CFR 388.112(b)(2(iii) to the confidential attachment relating to the proposed Rules of Conduct penalty distribution. Public Citizen also provided a signed copy of the form protective agreement included in the ISO’s November 8 filing.
Absent an objection to disclosure filed in Docket No. ER19-308, the ISO intends to provide Public Citizen with the requested materials by the expiration of the five-day deadline specified in 18 CFR 388.112(b)(2)(iv).
