The CEC has issued and served a subpoena on the ISO directing the ISO to provide certain data to the CEC for a variety of analytical tasks, which include:
- Preparation of the biennial Integrated Energy Policy Report
- Assessment of the replacement infrastructure needed to accommodate the retirement of aging facilities, including those that utilize once-through cooling
- Statewide and local electricity supply adequacy, including annual assessment of expected reliability during summer peak demand periods
This information also will be used to participate in CPUC activities pertaining to Resource Adequacy program design and implementation, and planning reserve margin-related proceedings.
The ISO will seek confidential treatment of such documents and information to the extent the requested documents and information are confidential or commercially sensitive under the ISO Tariff Section 20. This subpoena reflects collaborative revisions to the previous CEC subpoena issued in 2018.
Any market participant that objects to the ISO producing the requested documents and information must submit their objection by noon (Pacific Time) on Friday, May 31, 2019, along with a court order or other appropriate order that prohibits disclosure in response to the subpoena. Unless the ISO receives such an order by the listed due date, the ISO will thereafter respond to the subpoena.
