Public Comments and Legal Analysis on Regional Grid Now Posted to CEC, ISO Websites




Public comments, including a legal evaluation of an ISO regional grid, have been posted to the California Energy Commission (CEC) website. The legal evaluation is also available on the ISO website.

Public comments from the July 26, 2016 Joint State Agency Workshop on the proposed regionalization of the ISO are now posted to the California Energy Commission website. The workshop was a public discussion on the impacts of a multi-state western energy market, and a proposed governance structure for an expanded regional grid. Click here to view the comments.


Consistent with the established timeframe for the submission of comments, the California ISO has posted an evaluation of legal effects of regionalization as part of the comments, including whether California's environmental or clean energy laws would become more vulnerable to federal preemption or other constitutional challenges. In the Energy Commission's workshops on a regional grid operator and governance, as well as other public meetings, stakeholders raised questions about this matter. Prompted by those questions, the ISO engaged a group of noted law professors with expertise in this area to evaluate the issue.


The evaluation concludes that the addition of PacifiCorp as a participating transmission owner to the California ISO system will not create any new or additional risk of preemption for California's energy and environmental policies, nor will it alter the constitutionality of those policies.
