CPUC Storage Subpoena Issued

MESSAGE

The California Public Utilities Commission (CPUC) opened Rulemaking 10-12-007 to consider the adoption of procurement targets for viable and cost-effective energy storage systems. Under that rulemaking, decision 13-10-040 orders the CPUC to evaluate the Energy Storage Procurement Framework and Design Program adopted under the decision, and seeks documents that are material to the Commission’s on-going implementation of the energy storage procurement requirements in Rulemaking 10-12-007, pursuant to Public Utilities Code sections 2835-2839 and section 9506. At the heart of the study is an analysis of actual operations to date.

 

The CPUC served its Energy Storage Subpoena on the ISO on June 21, 2021.

 

The CPUC is requesting data from the ISO in seven categories: (1) inventory of energy storage resources and characteristics, (2) market settlements for energy storage resources, (3) bid data for energy storage resources, (4) geographic information, (5) operational data for energy storage resources, (6) selected non-storage resource data relevant to energy storage operations, and (7) other system or market data relevant to energy storage operations. The CPUC study team requires accurate and detailed information about energy storage resources participating in the ISO marketplace during the historical evaluation period 2017-2021, as well as other ongoing ISO system and market information relevant to assessing the performance of energy storage resources. The 2021 schedule for data releases is located on page 12 of Exhibit A to the subpoena. The confidentiality of any data disclosed is protected by a confidentiality agreement between the ISO and the CPUC.

 

Any market participant that objects to the ISO producing the requested documents and information must submit its objection by noon on July 9, 2021, along with a court order or other appropriate order that prohibits disclosure in response to the subpoena. Unless the ISO receives such an order by the listed due date, the ISO will thereafter respond to the subpoena.
